Chartwell Travel & Tours and its affiliates (herein referred to as Chartwell) act only as an agent/broker between the passenger and various suppliers of vacation products and services including, without limitation, airlines, hotels, cruise lines, agents, transfer companies and persons carrying out the services in connection with the vacations described in this brochure and/or website. All vacation services, including without limitation, guide services, hotel accommodations, meals, ground transfers and airline arrangements, are furnished by third parties (“suppliers”) who are independent of and do not act for, or on behalf of, Chartwell and with whom Chartwell has no owner/operator relationship as partner, joint venture or otherwise. All certificates and other travel documents for tour services issued by Chartwell are subject to the terms and conditions specified by the supplier and to the laws of the countries in which the services are supplied. Accordingly, passengers agree to seek remedies directly with the supplier and not to hold Chartwell liable.

Chartwell is not an insurance broker or agent and thereby disclaims any responsibility for claims or issues involving travel insurance. Accordingly you agree to seek remedies directly with the insurance company and not involve Chartwell, hold Chartwell harmless and to indemnify Chartwell for all expenses associated with such a claim.

Chartwell and its suppliers reserve the right to make cancellations, substitutions and/or changes at any time and for any reason, with or without notice, and Chartwell shall not be liable for any loss to passengers whatsoever by reason of such cancellations, substitutions and/or changes. All fares, as well as schedules, port calls, hours of arrival and departure, special programs, hotels and guest lectures (if applicable) are subject to change without prior notice. Chartwell shall not be required to refund any portion of the trip cost or make any other compensation due to such factors. Chartwell shall not be responsible for charges and/or penalties assessed by suppliers that may result from operational and/or itinerary changes, regardless of whether Chartwell or the passenger makes the vacation arrangements. The passenger will pay any additional expenses resulting from these circumstances or factors.

Chartwell reserves the right to substitute hotels of a similar category for the one listed in any description of the vacation itinerary. Specific room/cabin/seat assignments are at the sole discretion of the supplier and ultimately outside the control of Chartwell.

Chartwell reserves the right to increase the vacation price in the event of, without limitation to, cost increases due to changes in taxes, airfare, hotel, currency fluctuations or fuel surcharges and such charges are to be paid to Chartwell by the passenger upon notice to the passenger.

All rates are based on current tariffs and exchange rates in effect at the time of printing of the brochure and/or web posting and are subject to adjustment without prior notification in the event of changes therein or change in the number of participants on which the rates are based.

In the event of computer or human billing errors Chartwell reserves the right to re-invoice participants with correct billing.

Chartwell assumes no liability in whole or in part for any inconvenience, loss, including without limitation, any delays, delayed or changed departure or arrival, missed carrier connections, loss, damage, weather, strikes, acts of God, force majeure, war, quarantine, criminal activity, expense, accident, sickness, injury or death due to person, property or mechanical defect, failure or negligence of any nature, however caused, in connection with any accommodations, restaurant, transportation or other services or for substitution of hotels or common carrier equipment, with or without notice, or for any additional expenses resulting from any of these circumstances or factors. All baggage and personal effects are at all times and in all circumstances at the risk of the tour participant. The carrier, hotels and other suppliers who provide services are independent contractors; they are not agents, employees or servants of Chartwell. Chartwell is not responsible for any criminal conduct by third parties.

No refund will be made for any unused portion of any vacation due to any cause including, but not limited to, voluntary cancellations.

Legal proceedings against Chartwell may be instituted only in a state or federal court within the state of New Jersey, and any claim involved in such proceedings shall be decided in accordance with the laws of the state of New Jersey. Any legal proceedings against the company must be commenced within one year following the date of tour completion.

Chartwell shall not in any case be liable for other than compensatory damages, and you hereby waive any right to punitive damages.

Chartwell disclaims all oral representations including, but not limited to; vacation inclusions, terms of insurance coverage, representations of quality and weather.

Passenger is responsible for obtaining proper citizenship documents in advance of departure and presenting them at the designated check-in counter. Moreover, passenger is responsible for ensuring travel documents reflect his/her legal name, as they appear on passenger’s proof of citizenship. Citizens of the United States will require proof of citizenship when traveling to any country outside the United States. Only valid passports are acceptable for travel outside the United States. Non-US citizens require valid passport and applicable visas. Travel within the United States requires a government-issued photo identification, matching the name of your travel documents, to board an aircraft. Chartwell is not responsible for any loss, delays, or expenses related to passenger’s failure to possess the required citizenship documents and to present such documents when required. Proof of citizenship documentation requirements are subject to change without prior notice.

Every effort is made to ensure brochure and/or website accuracy, however, Chartwell cannot be held responsible for printing or typographical errors, or errors arising from unforeseen circumstances.

No person, other than an authorized representative of Chartwell by a document in writing, is authorized to vary, add, or waive any term or condition contained herein.

CUSTOM TRAVEL

Chartwell acts only as a broker between the passenger and various suppliers of products and services including, without limitation, airlines, hotels, cruise lines, agents, transfer companies and persons carrying out the services in connection with the vacation you have booked. Your payment serves as your agreement to accepting the terms/policies of those suppliers and you agree to seek any remedies directly with the supplier and to hold Chartwell harmless.

If you cancel your vacation, for any reason, your right to a refund is subject to the terms and conditions (a copy of which is available upon request) as set forth by the vacation supplier(s). Chartwell disclaims any oral representations regarding cancellation terms/policies of third party suppliers. Please note: Chartwell will charge a $75 administrative fee in addition to those cancellation fees charged by the vacation suppliers.
